I agree with your substance but it sort of is asking for a right but Roe would have had stronger foundational reasoning had it not in fact conjured a non-existent right to privacy and rather had declared that any law that unduly regulates pre-viability abortion is a religious or spiritually based law and thus violates the first amendment. https://medium.com/p/4d234daa2e71
