Yes, but there is a technical nuance that he missed. A holding can be affirmed on other grounds. The holding of Roe and the other privacy cases was correct but laying the foundation on a conjured right to privacy was not. Instead, the 1st Amendment's clause that prohibits the establishment of a religion would be firm ground. Please see my comment above.
